Lottus LLC – Service Agreement & Terms and Conditions

Legally Binding Agreement
​
These Terms and Conditions (“Agreement”) govern all cleaning services (“Services”) provided by Lottus LLC (“Lottus,” “we,” “us,” or “our”). By booking a service, submitting a payment, or using our website, you acknowledge and agree to be bound by this Agreement. If you disagree, do not book or receive services from us.

1. Booking & Confirmation
Booking a service online does not guarantee availability for the selected date or time. All bookings are subject to confirmation via email, text, or telephone.
To reserve your cleaning appointment, a non-refundable deposit of $70 is required. This deposit is applied toward the total service cost but is non-refundable under all circumstances, including cancellations, rescheduling, or dissatisfaction with scheduling availability.

2. Cleaning Crew
We typically work in teams of two technicians; however, larger teams may be assigned depending on the job’s size, complexity, or scheduling needs.
All Lottus cleaners undergo background checks and training. While we strive to keep the same technicians assigned to recurring homes, staffing changes, illness, or scheduling demands may require substitutions.

3. Right to Refuse Service
Lottus LLC reserves the right to refuse, discontinue, or terminate service at any time for reasons including, but not limited to:

Safety concerns

Inappropriate or hostile behavior

Dangerous or aggressive pets
-
Weapons on premises
-
Severe clutter or hoarding conditions
-
Biohazards (blood, feces, urine, vomit, mold, infestation)
-
Lack of utilities (water, electricity, HVAC)
If a technician arrives and determines the conditions are unsafe, unsanitary, or substantially different than those described, the service may be refused, and a $70 cancellation fee will apply.

4. Cleaning Day Preparation
To ensure accurate pricing and efficient service, the customer agrees to:

Remove clutter from floors, countertops, and surfaces

Secure valuables
-
Provide clear access to all areas scheduled for cleaning
If additional tidying, organizing, or decluttering is required, additional time will be billed, and the service price will be adjusted.

5. Add-On Services
Add-on services are available for an extra fee and must be requested in advance:

Interior windows & sills

Blind detailing
-
Baseboard detailing
-
Dishes
-
Inside kitchen cabinets

Inside oven

Inside fridge

Garage sweeping

Patio cleaning

Carpet washing

Additional deep-cleaning tasks

6. Pets
We are pet-friendly. However:

Pets must be secured or have limited movement for cleaning efficiency and safety.

If a pet becomes aggressive, anxious, or poses a safety risk, our technicians may leave the premises.
-
If service cannot be completed due to pet-related safety issues, the cancellation fee will apply.
Technicians will not enter a home if an unsecured pet is perceived as a threat.

7. Service Fees & Price Adjustments
Instant online pricing is based on typical conditions. Final pricing may change depending on:

Actual home condition
-
Additional dirt, grime, or buildup
-
Additional rooms or square footage
-
Excessive pet hair
-
Clutter, trash, or unreported conditions
If additional time or labor is required, we will attempt to contact the client before proceeding. If contact cannot be made, the team may leave, and the $70 cancellation fee will apply.
Lottus LLC reserves the right to adjust prices for recurring services if the time required significantly differs from the original estimate.

8. Payments

A $70 non-refundable deposit is required to reserve your appointment.
-
The remaining balance must be paid on the day of service.
-
Accepted payment methods: credit card, ACH, or other approved methods through our booking system.
-
Returned payments or chargebacks may incur additional fees.
​
9. Refund Policy
Payments are non-refundable. If something is missed, you must notify us within 24 hours, and we will return to address the issue at no additional charge. This is known as our Satisfaction Touch-Up Guarantee. Failure to notify us within 24 hours voids this guarantee.

10. Recurring Service Discount
Discounted recurring rates apply beginning after the first cleaning.
If a client skips, delays, or extends the interval between visits, the rate will increase to reflect the new cleaning frequency.

11. Rate Increases
Rates may be adjusted if:

Service frequency changes
-
The property undergoes renovations
-
Household size changes
-
Furniture or clutter significantly increases
-
Cleaning needs have materially increased
Clients will be notified in advance of any rate adjustments.
​
12. Lockouts
A guaranteed method of entry must be provided. If our team cannot access the property within 20 minutes, the appointment will be marked as a lockout, and the $70 cancellation fee will apply.
Lottus LLC is not responsible for lockout charges associated with alarm systems.
​
13. Rescheduling & Cancellations
To avoid the $70 cancellation fee, clients must provide at least 48 hours' notice for cancellations or rescheduling.
Same-day cancellations automatically incur the full cancellation fee.
​
14. Security Alarms
If your home has a security system, it must be disarmed before arrival, or the correct code must be provided. Clients are responsible for incorrect codes or resulting lockouts.
​
15. Homeowner’s Vacuum
If a customer requests that their vacuum be used:

Lottus LLC is not responsible for the condition or maintenance of the vacuum.

Lottus LLC will not assume liability for damage or malfunction.
If the vacuum does not function at the time of service, vacuuming will not be performed.
​
16. Cleaning Supplies
We bring all cleaning tools and products. If a client requests that we use their products:

Lottus LLC is not liable for any damages resulting from those products.
-
All supplies must be left in an accessible location.
​
17. Items We Cannot Clean
For health and safety reasons, we do not clean:

Mold (requires a specialist)
-
Hoarding environments
-
Animal or human waste
-
Blood, bodily fluids, or biohazards
-
Infested areas (fleas, bedbugs, roaches)
-
Litter boxes, bird cages, or pet urine

18. Unreachable Areas & Heavy Items
Technicians cannot:
-
Climb higher than a step stool
-
Move furniture over 35 pounds
-
Work outside the home
-
Access high shelves, vaulted ledges, or dangerous spaces
If you want cleaning behind heavy items, please move them before the appointment.
​
19. Damage, Breakage & Loss Policy
While rare, accidents can occur. Lottus LLC carries general liability insurance for breakage or damage caused by our technicians.
We are not liable for:
-
Normal wear and tear
-
Improper installation or unstable fixtures
-
Pre-existing damage
-
Items not disclosed as fragile
-
Artwork, collectibles, or heirlooms, unless disclosed in advance
Clients must report breakage, loss, or damage within 24 hours. An identical replacement will be attempted, but is not guaranteed.

20. Arrival Window
Due to traffic, weather, previous job overruns, and routing efficiency, arrival times are given as windows, not exact times.
Typical arrival window: 8:00 AM – 4:00 PM
Technicians typically arrive within 30 minutes early or 45 minutes late of the scheduled time.
We will notify customers via call or text if running significantly behind.

21. Holidays
Lottus LLC does not operate on the following holidays:

Independence Day
-
Thanksgiving
-
Black Friday
-
Christmas Eve
-
Christmas Day
-
New Year’s Eve
-
New Year’s Day
If your service falls on a holiday, we will contact you to reschedule.
​
22. Inclement Weather
If severe weather results in local school, road, or safety closures, Lottus LLC may pause operations for the day and reschedule appointments.
​
23. Keys & Access
Client keys are coded and stored securely. Only management has access.
If a client chooses to leave a key in an unsecured area (under a mat, unlocked door, etc.), Lottus LLC is not responsible for any resulting damages or theft.
Upon cancellation or termination of service, keys will be returned within 48 hours or the next business day.

24. Non-Solicitation of Lottus LLC Staff
Clients agree not to hire, solicit, or attempt to employ any Lottus LLC employee or contractor for personal services outside this Agreement during service and for 24 months following termination of services.
A violation of this clause results in a $3,000 finder’s fee payable to Lottus LLC.

25. Limitation of Liability
To the maximum extent permitted by law:

Lottus LLC is not liable for indirect, incidental, punitive, or consequential damages.

Total liability for any claim shall not exceed the amount paid for the specific service in dispute.

Lottus is not liable for losses due to theft, fire, water damage, or natural disasters.

26. Governing Law
This Agreement is governed exclusively by the laws of the State of Colorado, without regard to conflict of law principles. Any disputes shall be resolved in Denver County, Colorado.

27. Changes to Terms
Lottus LLC reserves the right to modify these Terms & Conditions at any time without prior notice. Updated terms will be posted on our website.

28. Acceptance of Terms
By booking, paying for, or receiving services from Lottus LLC, you acknowledge that you have read, understood, and agreed to all terms in this Agreement.
